The Foreign Contribution Regulation Act (FCRA) regulates the acceptance and utilization of foreign contributions by individuals, associations, and NGOs in India. FCRA registration is mandatory for any organization wishing to receive foreign funds legally.
To be eligible for FCRA registration, an NGO must be registered for at least three years and must have spent a minimum of Rs 15 lakh on its core activities over the past three years. The organization must also have a proper accounting system and audited financial statements.
The application process is entirely online through the FCRA portal (fcraonline.nic.in). You need to submit the application in Form FC-3A along with required documents including registration certificate, audited statements, activity reports, and bank details.
A key requirement is designating a separate bank account exclusively for foreign contributions. This account must be opened in a branch of the State Bank of India at New Delhi, as mandated by the FCRA rules. All foreign funds must be routed through this account only.
The processing time for FCRA registration is typically 90 days, but can take longer if the government seeks clarification. Once granted, the registration is valid for five years and must be renewed six months before expiry.
Compliance after registration is critical. NGOs must file an annual return in Form FC-4 within nine months of the end of the financial year. The return must include details of foreign contributions received, utilized, and unutilized balances.
Foreign contributions can only be used for the specific purposes mentioned in the application. They cannot be used for administrative expenses beyond 20% of the total received. Diverting funds for other purposes can lead to cancellation of registration and legal action.
